Terms of Service

$95 per hour for overtime. All overtime shall be paid to Luxe Booth NW prior to the contracted ending time. All overtime payments must be in cash or via invoice. No refunds will be given for events lasting fewer hours than contracted for. 

In the event that the above date or event is cancelled, all payments and pre-payments are NON-REFUNDABLE. In the event of a natural disaster or government shutdown of your event, all deposits will be transferred to a date of your choice within one year of the original contracted date upon availability.

All cancelations must be in writing and received by Luxe Booth NW at least ninety (90) days prior to the contracted event or the purchaser is fully and completely liable for the entire balance owed in the following paragraph. Purchaser shall also be liable for all court costs and attorneys’ fees incurred by Luxe Booth NW if contract terms are breached and/or not fulfilled completely by the purchaser.

Final payment due at least fourteen (14) days prior to the contracted event. If balance is not paid in full within this time frame, then the contracted event will be considered cancelled, and all deposits will be forfeited. Luxe Booth NW reserves the right to make a substitution in case of a severe illness or circumstances beyond our control.  

Terms and Conditions

 Booth Requirements: 

The Photo Booth requires the following for operation purposes: 

-10’ x 15’ solid level floor space

-One (1) 120V electrical three (3) prong outlet rated for at least 10 amps within fifty (50) feet (along a wall) of the set-up area. The circuit must be free of all other connected loads.

If the event is scheduled to be outdoors, the purchaser shall furnish at their expense, a 10’ x 10’ leak proof protective tent with sidewalls to cover the Photo Booth, the booth attendants and all provided equipment.      

If the contracted event is scheduled to occur on other than a ground floor level, purchaser shall confirm with the venue there is a working elevator available for load in and load out of the Photo Booth. If no elevator is available, the purchaser shall supply, at their expense, additional professional assistance to help load in and load out the Photo Booth to the non-ground level. 

Luxe Booth NW and its employees/agents shall have the right to refuse to set up the photo booth if the above requirements are not provided and/or suitable - at their sole discretion. Purchaser shall be fully liable for any damage done to the Photo Booth due to negligence by the purchasers or their guest’s (invited or uninvited) or due to inclement weather damage resulting from unsuitable conditions and/or insufficient tenting at the event. Purchaser shall furnish at the purchaser’s expense one (1) electrical drop meeting the requirements set forth above at the photo booth set up area.

 

Event Details: 

Purchaser acknowledges and agrees to complete the required event questionnaire with a minimum of 14 days prior to the event. Purchaser acknowledges if the questionnaire is not complete before the 14 day requirement the Purchaser forfeits the right to choose details for their event such as: backdrop, props, graphic design elements, etc. If the event is booked within the 14 day period, the Purchaser agrees to give Luxe Booth NW control and permission to make design decisions as needed based on availability (props, equipment, backdrops, etc.)

 

Print Design Approval:

Luxe Booth NW will email a proof of your print design before your event. Please examine your proof carefully. Once you approve the proof for your event, Luxe Booth NW is not responsible for any errors. If the purchaser fails to approve the design within the provided time frame, Luxe Booth NW will deliver the design as is. 

 

Change of Date or Venue:

Luxe Booth NW must be notified immediately of any changes in schedule or location, at least 14 days prior to the scheduled date of event. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be sent back by the Luxe Booth NW in writing or via email. It is the purchaser’'s responsibility to confirm all arrangements at least 14 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify the Luxe Booth NW.

 

Operation:

There is a possibility of booth down time at your event in order for attendants  to change necessary operating media (photo paper, toner, etc.) and is expected to take no more than 20 minutes. This time is figured into the total rental period and will not be credited to the purchaser.

 

Forced Idle Time:

If the attendant cannot remove the photo booth from the event at the conclusion of the contracted time, the purchaser will be billed at the standard idle time rate of $55 per hour until the booth can be removed without affecting the event in a negative manner.

 

Crowd Control/Safety: 

Purchaser acknowledges Luxe Booth NW shall have the right to refuse service to purchaser’s guest (invited or uninvited) for misuse, abuse, unruly behavior or any other inappropriate actions or behaviors in the sole discretion of Luxe Booth NW and/or its employees/agents. The purchaser shall be responsible to provide crowd control as may be necessary and if warranted. 

 

Purchaser acknowledges that they shall be responsible for any damage or loss to the photo booth caused by any misuse of the equipment by purchaser or purchaser’s guest (invited or uninvited). Any loss/theft of props or equipment by purchaser or purchaser’s guest (invited or uninvited) shall be paid for by the purchaser who shall be charged a $100.00 replacement or damage fee for any damaged or missing props not returned to the photo booth by the end of the event. This fee shall be automatically charged to the purchaser'sto purchaser’s credit card on file or shall be paid for by the purchaser at the end of the event. 

 

Luxe Booth NW attendants expressly reserve the right to terminate and/or refuse service and/or depart from the venue before the contracted time is complete if the purchaser and/or its guest (invited or uninvited) harass, threaten, or abuse Luxe Booth NW and its employees/agents, and/or the photo booth and related equipment is damaged or if service is disrupted for any reason, in which NO REFUNDS shall be given. 

 

Children love our photo booths, and we love making everyone happy. In some cases, however, it becomes necessary to enforce our “no children under 13” policy to maintain safety and order in and around the Photo Booth. The “no children under 13” policy states that children under the age of 13 shall not be permitted to utilize the Photo Booth without an adult present. The adult does not need to be in the photo booth with the child/children, but they must be supervising. We very rarely must enforce this policy but shall not hesitate in the event of an incident that affects the safety of others or the equipment itself.

 

Attendant requirements:

Purchaser agrees to provide the following to Luxe Booth Attendants: 

Event Food Service: Luxe Booth NW requires a vendor or guest meal to be provided for each staff member at all catered events. 

Access to drinking water and/or provided bottled water

Access to a restroom

       

Photo Release:

The purchaser agrees to and understands the following: 

All guest (invited and uninvited) using the Photo Booth hereby give Luxe Booth NW and Photo Booth the right and permission to copyright and use photographic portraits or pictures of any Photo Booth user who may be included intact or in part, made through all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, purchaser hereby releases, discharges, and agrees that Luxe Booth NW, its employees/agents, and The Photo Booth and its related entities, from any liability that may occur or result from taking of pictures and photographs or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel, invasion of privacy, or unauthorized use of image. All photographs and pictures are the property of Luxe Booth NW and The Photo Booth. The commercial use of the photographs and pictures without proper acknowledgement/permission from Luxe Booth NW and The Photo Booth is prohibited. Luxe Booth NW and The Photo Booth are not liable for missing photographs or pictures, if any. All permits and permissions required for The Photo Booth to photograph and be on location at the event even whether for location, personal release, or any other cause, are the responsibility of the purchaser to obtain at their expense, if any.   

 

Liability:

Luxe Booth NW shall have no responsibility or liability to the purchaser for any loss, damage, delay or prevention of the completion of any booking resulting from an act of god, seizure, sanctions, quarantine restrictions, pandemic, epidemic, fire, volcanic eruption, earthquake, flood, windstorm, hurricane, weather, riots or civil commotion, strikes, labor stoppage, war or any other acts, matters or things, whether or not of a similar nature, which are  beyond the control of Luxe Booth NW. If an unforeseeable circumstance prevents Luxe Booth NW from completing or makes it unreasonable for the Purchaser to complete the booking contemplated by this Agreement, Luxe Booth NW shall make reasonable efforts to provide alternative dates to the Purchaser upon availability. Purchaser fully agrees that all of the purchaser's guests who use the Luxe Booth NW photobooth are using the photobooth on their own free will and agree not to hold Luxe Booth NW liable for any matters at all whatsoever that may arise in the future.

 

The signatures below confirm that all parties have read and understand all terms and provisions of the foregoing agreement and this contract. It must be fully signed by the purchaser together with the down payment no later than five (5) days from the date of this Contract or this contract/agreement shall be deemed null and void without further notice.
